TERMS OF ENGAGEMENT

These terms govern the services provided by Wifi and Fences. Please select the relevant service below and read the terms carefully before booking.

Pool Safety Inspections — Queensland. Wifi and Fences operates under the Queensland Building and Construction Commission (QBCC) framework. These terms apply specifically to pool safety inspection services.

Wifi and Fences — ABN 58 148 139 338 — is a licensed pool safety inspector registered with the Queensland Building and Construction Commission (QBCC). These Terms of Engagement apply to all pool safety inspection services. By booking an inspection, you agree to these Terms.

1. ENGAGEMENT OF SERVICES

By engaging Wifi and Fences (ABN 58 148 139 338) to perform a pool safety inspection, you ("the Client") agree to be bound by these Terms of Engagement.

These terms apply to all pool safety inspection services provided by Wifi and Fences, including initial inspections, re-inspections, and any associated advisory services.

Wifi and Fences is a licensed pool safety inspector operating under the Queensland Building and Construction Commission (QBCC) framework and in accordance with the Building Act 1975 (Qld) and the Building Regulation 2021 (Qld).

2. SCOPE OF INSPECTION

A pool safety inspection is a visual assessment of the pool safety barrier and associated features to determine compliance with the applicable Queensland pool safety standard.

The inspection covers the pool safety barrier (fencing, gates, latches, and non-climbable zones), the pool area, and any relevant structures that may affect barrier compliance.

The inspection does not include assessment of the structural integrity of the pool shell, pool equipment, water quality, electrical systems, or any features not directly related to the pool safety barrier.

The inspector will assess the property against the applicable pool safety standard in force at the time of inspection. Older pools may be assessed against a different standard than newly constructed pools — the applicable standard will be confirmed prior to or at the time of inspection.

3. POOL SAFETY CERTIFICATES

If the pool safety barrier is found to be compliant, Wifi and Fences will issue a Pool Safety Certificate (Form 23) and lodge it with the QBCC on your behalf.

A Pool Safety Certificate is valid for two (2) years for a non-shared pool and one (1) year for a shared pool (e.g. body corporate properties).

If the pool safety barrier is found to be non-compliant, a Notice of Non-Compliance (Form 26) will be issued. This notice details the items requiring rectification before a certificate can be issued.

The Client is responsible for arranging and funding all rectification works identified in a Notice of Non-Compliance. Wifi and Fences can provide guidance on the required works but does not undertake rectification as part of the inspection service unless separately engaged.

4. RE-INSPECTIONS

Where a Notice of Non-Compliance has been issued, a re-inspection will be required once rectification works have been completed.

Re-inspections are charged at the applicable re-inspection fee as quoted at the time of booking. The re-inspection fee is separate from the initial inspection fee.

The Client must notify Wifi and Fences when rectification works are complete and schedule a re-inspection. Wifi and Fences will not attend for re-inspection without prior booking.

If rectification works are not completed within the timeframe specified on the Notice of Non-Compliance, the Client may be required to notify the local government authority. Wifi and Fences accepts no liability for any consequences arising from failure to complete rectification works within the required timeframe.

5. FEES & PAYMENT

Inspection fees are as quoted at the time of booking and are payable prior to or on the day of inspection unless otherwise agreed in writing.

Fees are inclusive of GST where applicable.

Payment may be made by bank transfer, credit card, or other methods as agreed at the time of booking.

Where an inspection is cancelled with less than 24 hours notice, a cancellation fee of up to 50% of the inspection fee may apply.

Where access to the property cannot be obtained at the scheduled time due to circumstances within the Client's control, the full inspection fee may be charged.

6. ACCESS TO PROPERTY

The Client must ensure that the inspector has safe and unobstructed access to the pool area and all relevant parts of the property at the scheduled inspection time.

The Client warrants that they have the authority to grant access to the property for the purpose of the inspection.

Where the property is tenanted, the Client is responsible for ensuring appropriate notice has been given to the tenant in accordance with the Residential Tenancies and Rooming Accommodation Act 2008 (Qld).

If a pet is present on the property, the Client must ensure the pet is secured prior to the inspector's arrival.

7. LIMITATION OF LIABILITY

The pool safety inspection is a visual assessment only. Wifi and Fences does not accept liability for defects or non-compliance issues that were not reasonably observable at the time of inspection, including issues concealed by vegetation, structures, furniture, or other obstructions.

Wifi and Fences' liability to the Client is limited to the fee paid for the inspection service. Wifi and Fences is not liable for any consequential, indirect, or special loss or damage arising from the inspection or any report or certificate issued.

Nothing in these terms limits any rights the Client may have under the Australian Consumer Law.

Wifi and Fences holds current public liability insurance. Details are available upon request.

8. REPORTS & CONFIDENTIALITY

Inspection reports and certificates are prepared for the benefit of the Client and relate to the property inspected at the time of inspection.

Reports and certificates must not be relied upon by third parties without the written consent of Wifi and Fences.

Wifi and Fences is required by law to lodge Pool Safety Certificates and Notices of Non-Compliance with the QBCC. This lodgement is not a breach of confidentiality.

Personal information collected in connection with the inspection will be handled in accordance with the Privacy Act 1988 (Cth) and will not be disclosed to third parties except as required by law or with the Client's consent.

9. COMPLAINTS & DISPUTES

If you are dissatisfied with any aspect of our service, please contact us in the first instance at [email protected] so we can attempt to resolve the matter.

If the matter cannot be resolved directly, complaints regarding pool safety inspectors may be lodged with the QBCC at www.qbcc.qld.gov.au.

These terms are governed by the laws of Queensland, Australia.

10. AMENDMENTS

Wifi and Fences reserves the right to amend these Terms of Engagement at any time. The terms in force at the time of booking will apply to that engagement.
